Abstract
RESUMEN**
Históricamente el ser humano ha evidenciado sus instintos primarios a través de la reacción penal en el Derecho, defendiendo sus intereses con violencia. La pena de muerte, así como los castigos corporales han sido parte de los sistemas judiciales desde el principio de la existencia de estos mismos. La sangre y la excesiva crueldad marcaron el Derecho Penal Antiguo, destinado fundamentalmente a las penas capitales e infamantes, que se fueron humanizando con el desarrollo de las ideas iluministas que se dieron en la primera mitad del siglo XVIII.

ABSTRACT
Historically the human being has demonstrated his primary instincts across the penal reaction in the Law, defending his interests with violence. The death sentence, as well as the corporal punishments has been a part of the judicial systems from the beginning of the existence of these themselves. The blood and the excessive cruelty marked the Ancient Criminal law, destined fundamentally to the death and offensive penalties, which were more human with the development of the ideas of the Illuminist that gave each other in the first half of the 18th century.
