Abstract
Within the framework of the 1991 Political Constitution, it is necessary from our legal system the primacy of the material law over the forms. In this sense, this article seeks to highlight the situation of labor rights and social security of sex workers in Barranquilla as a minority group. In the first instance, the reader is connected to the doctrinal categories of sex work and prostitution, in order to highlight the clear difference between one category and the other. This is necessary to clarify the meaning of the present work, which is the analysis of the legal and labor conditions derived from sex work. In order to achieve this analysis, we have outlined a methodological design using the socio-legal paradigm. Seeking to establish the impact of the norm in society. In the first instance, mentioning the jurisprudential advances on the legal situation of these workers in our country. And secondly, to contrast them with interviews conducted with sex workers in the North-Historic Center of Barranquilla. With the purpose of analyzing if these legal guarantees delivered by means of jurisprudence are palpable or not, if they remain in letter or if they really impact on society, if the principle of the Social State of Law, the substantial right, is achieved. Finally, we will draw conclusions.
