Disciplinary Relevant Facts in the Disciplinary Process: Analysis from Law 1952 of 2019 and its Reform

Abstract
With the enactment of Law 1952 of 2019, disciplinary facts have assumed a preponderant place in the disciplinary process. While they were already established in previous legislation, no reference was made to disciplinary facts, such as the budget or requirement of the decision that orders the opening of the disciplinary investigation (Article 154), or the decision by which the charges are filed against the investigated person (art. 163) in the General Disciplinary Code. Today, disciplinary facts mark the central axis of the disciplinary investigation, understood as the set of factual points that may come in the complaint, the report of a public servant, or any news of which the disciplinary authority is aware that could be framed in what the law has established as a fault. This activity allows the disciplined person to know at least provisionally what could be, at least tentatively, the reproach that is being investigated, which guarantees the exercise of the right to defense and contradiction in case he or she opposes them, or even to proceed to access the benefit of the confession in case he or she decides to accept the occurrence of the same and its consequential effect in terms of disciplinary liability.
