Abstract
Habermas from the exercise of Critical Theory identified a crisis of legitimation in capitalist societies product of a decoupling and subsequent colonization of what he defined as the world of life. In his work Theory of Communicative Action and with his proposal for discourse ethics, he tried unsuccessfully to reconstruct the legitimacy of modern societies. Therefore, his work Facticity and validity should be interpreted as a reformulation of his theory of communicative action where he sought to bring the assumptions of communicative reason closer to the contexts of democratic States of Law, proposing for this the concept of co-originality between rights and popular sovereignty as a way to rebuild the legitimacy of law and modern societies.
