Abstract
La demanda de Coparte antes de la expedición del Nuevo Código General del Proceso había sido una institución completamente extraña al ordenamiento jurídico colombiano, por cuanto en las figuras consagradas legalmente a la fecha, no se encuentra alguna que se ajuste a las características que le son propias, es decir, la posibilidad de que en un mismo litigio se resuelva la controversia jurídica nacida entre la parte demandante y la demandada, así como la que surja en el extremo pasivo entre sí; de esta manera pese a las bondades que tal figura conlleva al ser la concreción del principio de economía y celeridad procesal, sólo el legislador, con la expedición de la ley 1564 de 2010, dio vía libre para su utilización en el derecho Colombiano; lo anterior, al variar la prescripción normativa de la figura ya conocida del llamamiento en garantía, toda vez que a la entrada en vigencia de la nueva normatividad, esta última no sólo permitirá la concurrencia forzosa de terceros a un determinado proceso judicial, sino que también será posible llamar en garantía a aquél con quien se comparte el mismo extremo procesal, el pasivo.

ABSTRACT
Demand Coparte before the issuance of the New General Code of Process had been a total strangeness to the Colombian legal system institution, there is not a figure that fits the peculiar characteristics of this case; ie, the possibility that just in the only legal dispute arising between the plaintiff and the defendant could be resolved; thus despite the advantages that such figure carries, by being a realization of the principle of economy and celerity, only the legislature, with the enactment of Law 1564 of 2010 cleared the way for its use in the Colombian law; the above, by modifying the rules prescribing the figure of the calling under warranty, ever since the enactment of the new regulations, the latter will not only enable third-party compulsory attendance to a particular trial, but it also opens the possibility to call under warranty to the one to whom the judicial end is shared, the passive.
