Abstract
RESUMEN
La responsabilidad del Estado ha supuesto, históricamente, la constante construcción jurisprudencial que evidencia la evolución del estadio de la irresponsabilidad absoluta hasta la reparación estatal de los daños que éste cause, de manera objetiva, y su consagración constitucional. Tal progreso institucional permite entender que la responsabilidad no se circunscribe a la actuación administrativa, de manera que se extiende también a las diversas modalidades de funciones estatales, siendo en consecuencia el Estado igualmente responsable por los daños que cause en sus actuaciones legislativas y judiciales. Particularmente esta responsabilidad se puede configurar en la contumacia del Estado en el cumplimiento de sentencias judiciales. Se argumenta entonces que existen diversas hipótesis de responsabilidad estatal que pueden conducir a la reparación de daños, en el incumplimiento de sentencias por parte del Estado.

ABSTRACT
State responsibility has meant, historically, the constant development of case law that demonstrates the evolution of absolute irresponsibility stadium to state repair the damage that this causes, objectively, and constitutional entrenchment. Such institutional progress can understand that the responsibility is not limited to the administrative action, so that also extends to the various forms of state functions, therefore the state being equally responsible for any damage caused in its legislative and judicial actions. Particularly this responsibility can be configured in contempt of the State in the exercise of judicial decisions. It then argues that there are various hypotheses of state responsibility that can lead to damages, breach of judgments by the state.
